The Victim of Domestic Violence Visa category is for persons that have suffered from certain forms of domestic violence or abuse during their marriage and qualify for Indefinite Leave to Remain in the UK under this category.

Eligibility for a Victim of Domestic Violence Visa 

In order to be eligible for a Victim of Domestic Violence Visa, your first grant of leave to enter or remain in the UK must have been as the partner of a British citizen or a person settled in the UK or a person with refugee leave; and, any subsequent grants of leave to remain in the UK must also be granted on the same basis.

In order to qualify for a Victim of Domestic Violence Visa you will need to satisfy UK Visas and Immigration (UKVI) that:

  • You are present in the UK with your last grant of leave to remain in the UK as the partner of a British citizen, settled person or a person with refugee leave;
  • Your relationship with your partner had broken down permanently as a result of domestic abuse; and
  • Your application does not fall to be refused under general reasons for refusal on suitability grounds.
